Amend the Digital Millennium Copyright Act DMCA

Congressmen from California and Virginia have introduced a bill that proposes to amend the Digital Millennium Copyright Act in order to loosen the increasingly harsh usage restrictions that are being applied to digital content.

The DMCA “dramatically tilted the copyright balance toward complete copyright protection at the expense of the public’s right to fair use.” Without a change in the law, individuals will be less willing to purchase digital media if their use of the media within the home is severely circumscribed and the manufacturers of equipment and software that enables circumvention for legitimate purposes will be reluctant to introduce the products into the market.

The bill, which is entitled titled Freedom and Innovation Revitalizing U.S. Entrepreneurship (or FAIR USE), is already being backed by the Consumer Electronics Association and “among others.

Harry Potter Books Piracy and Ebay

J K Rowling, author of Harry Potter, has sued online auction portal eBay India for allowing unscrupulous sellers to sell unauthorised versions of her books. Rowling has obtained an injunction from Delhi High Court that prohibits eBay from listing illegal copies of her work.

Rowling’s legal adviser, has said, “We have asked eBay on numerous occasions to assist by taking preventative steps to avoid these sales — steps that we are aware they can introduce. As these requests were not heeded we had no choice but to seek judicial intervention.â€?

eBay denies that it is responsible for the auctions its users conduct on its website, and claims that it is impractical for it to vet every sale. Rowling’s lawyers, however, claim that if eBay profits from sales of illegal goods then it should be held liable.

Trademark issue Microsoft

A company called Office Live has filed a trademark infringement lawsuit against Microsoft over the software giant’s use of “Office Live” for its on-demand productivity tools.

Office Live, which runs sites such as Accountantsofficelive.com, Legalofficelive.com and Realtorsofficelive.com, offers free professional advice to consumers and offers customer leads to businesses. The company is seeking an injunction to prevent Microsoft from using the “Office Live” name.

Lenny Targon, Office Live chief executive, said in a statement: “It is shocking that Microsoft would have so little regard for another company’s intellectual property rights that it would select a name belonging to another company. Online software may be the next big thing but Microsoft has no right to use our trademark without permission.”

Microsoft said it views the word ‘Live’ as a descriptor, such as in the case of “AOL Live” and “Vodafone Live”, and has indicated that stance to Office Live LLC in previous discussions.

A Hacker’s investigation of Superior Court Judge Ronald C. Kline’s computer has finally resulted him being sentenced to 27 months in federal prison for possession of child pornography.

The case was all started when a Canadian hacker Brad Willman broke into the judge’s Irvine home computer and discovered sexually explicit images of young boys and a diary that revealed Kline’s fantasies involving young boys. A subsequent police search of the Judge’s court computer revealed more images and more dodgy Web sites.

Hunting Criminals via Web

Criminal hunting methods are changing more and more according to the development of new technologies and  instruments but recently, a strange trend is revolutionizing criminal investigation techniques..

 The trend consists in making pleas about cases of  murders, kidnappings, burglaries and other crimes on social networks such ad MySpace in order to hit the attention of the widest range of people and possibly collect information to help investigations. In other words, these pleas work as high-tech equivalents of “wanted” posters.

For instance, relatives of a Chicago doctor who was murdered last October,  posted on MySpace.com a surveillance video showing a blood-spattered young man rushing from the building.

The son of the victim explain this choice as an attempt to gain attention on the case:  “Young people between 18 and 25 are probably not watching the nightly news or reading the newspaper every day. That audience is probably on the Internet, and they all have MySpace.”
 

After they posted on MySpace an announcement offering a $25,000 reward, the website received more than 40,000 hits in six weeks, whereas Chicago Police admitted they hadn’t received any call but just a few e-mails.

Domain Name Dispute Resolution New Zealand

New Zealand has recently adopted a new dispute resolution procedure for resolving .nz domain name disputes.

Under the new procedure, you can lodge a complaint with InternetNZ where a third party has registered or is using a domain name that is identical or similar to a name in which you have rights. This came into effect on 1 June 2006.

The parties to the complaint are first invited to take part in informal mediation with InternetNZ to resolve the dispute. There is no official fee for this mediation.

If the informal mediation does not resolve the dispute, the complaint can proceed to be determined by an independent expert. In determining if a domain name has been inappropriately registered the expert applies a two step test, which requires that you prove:

    * you have either registered or unregistered trade mark rights (or other similar rights) in respect of a name or mark that is identical or similar to the domain name; and

    * the domain name is, in the hands of the current registrant, an “unfair registration”.

To be considered an “unfair registration” the domain name registration must take unfair advantage of, or be unfairly detrimental to, your rights in the name.

McAfee wins over its Domain Name from Cyber Squatter

In an impressive victory by McAfee Limited against the Cyber Squatters, who are posing the great threat to the domain names of rightful owners, McAfee wins the disputed domain name www.mcafee.co.in in its favour.

In the above case the complainant McAfee Inc, a company registered under the laws of the State of California, USA filed a complaint with National Internet Exhange of India (NIXI) against Chen Shenglu, 1607, East Jinghuayuan, Xiangmei Road, Shenzhen, Guangdong – 518000, China for allegedly registering the disputed domain name www.mcafee.co.in in its own name.

Mr. Amarjit Singh, a sole arbitrator appointed by National Internet Exchange of India (NIXI) to adjudicate upon the dispute for the said domain name, ruled that the disputed domain name www.mcafee.co.in is identical and confusingly similar to the trade mark, trade name, service mark and domain name of the complainant McAfee Inc and the respondent holds no right or legitimate interest therein. It was also ruled that the respondent misrepresented himself in the course of trade to unwary internet users made active use of domain name on account of bad faith registration under the circumstances of the case. It was also observed by the panel that the respondent had registered several other domains consisting of well-known trade mark in bad faith so as to earn profits from the prevailing industry of cyber squatting.

NOTE:
The term cyber squatting means registration and use of a domain name with bad faith or with intent to trade upon the goodwill and reputation of a trade mark / trade name of rightful owner and thereby earn profits. Cyber Squatters often register domain names identical or deceptively similar to well-known trade marks / trade name and then offer the same to the rightful owners on exorbitant consideration or cause confusion to internet users to buy inferior quality goods or services considering the same to be of original owner.

The National Arbitration Forum reports that their domain name disputes resolutions increased by 21% in 2006 compared to 2005. The National Arbitration Forum handled 1,658 Internet trademark disputes in 2006, making it the largest filing year since the inception of their domain name dispute program. Notable disputes involved famous trademarks such as George Foreman, Stevie Wonder, Vin Diesel, Louis Vuitton and the New York Yankees.
