Google Web Search Ranking Case

Google Web Search Ranking Case

A US judge has thrown out a lawsuit challenging the fairness of how Web search leader Google Inc. calculates the popularity of Web sites in determining search results, court papers show.

KinderStart sued Google in March 2006 alleging the Mountain View, California-based Internet company had defamed the site by cutting it from its Web search ranking system.

The Norwalk, Connecticut-based company, which features links to information about raising children, accused Google of violations of antitrust, free speech, unfair competition and defamation and libel laws.

In its suit, the company argued its site’s sudden demotion in March 2005 to a “zero” ranking in Google’s search system had severely harmed its business.

KinderStart had sought class action status on behalf of what is said were many other sites that suffered the same fate as Google fine-tunes Web site rankings in search results.

Microsoft look-alike names

Microsoft look-alike names

Microsoft is ramping up legal action against organisations that have registered Microsoft look-alike names. The move follows claims by the World Intellectual Property Organisation that the integrity of the domain name system is under increasing threat from trademark infringements and cybersquatting.

Cybersquatters register Internet domain names (such as winowslivemessenger.com and www.micr0soft.co.uk in the case of Microsoft) containing misspelled variations of widely recognised trademarked names and brands. They aim to diret users to sites filled with pay-per-click advertisements which can generate revenue for the registered domain owner and the online ad network.

Microsoft says it has reclaimed more than 1,100 infringing domain names worldwide in the past six months.

Hacker with an Indian passport in a Tokyo prison

Hacker with an Indian passport in a Tokyo prison

A hacker with an Indian passport in a Tokyo prison. An alleged victim in Hawaii. The hacker’s mother in India seeking a bailout.

With this cast of characters in play, the Delhi High Court has, in a precedent to international cyber crime cases, ruled that the Indian government cannot step into the matter on behalf of the accused.

Rajdutta Patkar is a software professional with an Indian passport. In late 2004, a US businessman based in Hawaii discovered that his e-mail address had been hacked and “vital text and image documents accessed by a hacker. Investigators later tracked down the IP address and pathways used by the hacker and zeroed in on Patkar. With sufficient evidence against him, a US court registered a case against him.

On the run, Patkar was arrested in Japan in June last and, according to authorities there, is currently in detention in Kusog Detention Centre, Tokyo.

US authorities have, meanwhile, applied for his custody to stand trial in the hacking case in Hawaii or any designated US State. The matter is currently with Japanese officials. The two countries have ratified extradition treaties to cover cyber crime, including the landmark Budapest Treaty, under which citizens of a third country can also be extradited.

Back home, the mother of the accused filed a petition with the Delhi High Court to instruct the Ministry of External Affairs to intervene and secure the professional’s return from Japan.

Justice B D Ahmed heard the petition in the light of Patkar’s citizenship and the mother’s contention that the case was a motivated one and baseless. The counsel for the Centre, however, argued that given the nature of the case and the existing laws in the two countries involved, the Indian government could not intervene at this stage.

U.N. copyright agency and abusive registrations of trademarks as Internet domain names

U.N. copyright agency and abusive registrations of trademarks as Internet domain names

The U.N. copyright agency that arbitrates more than half the world’s “cybersquatting” cases saw a 25 percent increase in complaints last year.

The World Intellectual Property Organization received 1,823 complaints in 2006 alleging abusive registrations of trademarks as Internet domain names.

The complaints came mainly from information technology, financial and pharmaceutical companies, as well as famous fashion brands and the entertainment industry.

The growing number of professional domain name dealers who use computer software that automatically registers expired domain names or temporarily registers them without paying charges, is of concern to trademark owners, WIPO said.

Hacking LexisNexis law database

Justin A Perras, 20, of New Bedford, was one of five co-defendants who confessed to hacking into the systems of LexisNexis, the law database giant.
