France has introduced new anti-piracy legislation, backed by entertainment industry heads and president Nicholas Sarkozy.

The Creation and Internet Bill also sets up a new state agency called the Higher Authority for the Distribution of Works and the Protection of Copyright on the Internet (Hadopi).

Users found to be downloading content illegally will be sent a warning email by the Hadopi, followed by an official letter if they continue to break the new law.

Repeat offenders could also be brought before a judge and imposed with fines or even have their internet access revoked.

People who persist in swapping copyrighted films and music will have their internet connections cut off under tough new laws to be proposed by the government .

The measures also include taking the power to target illegal downloaders away from regulator Ofcom and giving it to ministers to speed up the process.

The decision to cut off peer-to-peer filesharers is unexpected since it was ruled out by the government’s own Digital Britain report in June as going too far.

The government will take the unusual step of proposing much stricter rules midway through the Digital Britain consultation process. Illegal filesharers will still get warning letters but if they continue to swap copyrighted material they could have their internet connection temporarily severed, although it may be possible to retain basic access to online public services.

The music and film industries had campaigned hard to have measures introduced earlier than 2012 and the fact that persistent pirates can be cut off is likely to be welcomed. The UK’s internet service providers, however, will be less pleased by the plans. Several have made it quite plain they have no desire to police the web on behalf of another industry.

Downloading Music or Films and Law

French lawmakers reject a bill that proposed disconnecting Internet users if they download music or films illegally. French President Nicolas Sarkozy backed the bill.

The Internet bill, which is heavily supported by the music industry, would give users caught illegally downloading files two warnings and then, after a third violation, have them disconnected from the Internet for up to a year.

Under pressure from a struggling music industry, governments have long been trying to crack down on online file-swapping.

Some consumer groups have said that the proposed law could hit the wrong people, and that honest users risked being unfairly punished and forced to prove their innocence if hackers hijacked their computers’ identity.

The music industry has been lobbying for similar laws to be introduced around the world. In January, Irish Internet provider Eircom agreed to disconnect users who download music illegally in a settlement with four major record companies.
